These Terms of Service ("Terms") govern your use of the OptionsAware Telegram bot, website, and any related services (collectively, the "Service"), operated by Scathefire Media Inc ("we," "our," or "us").
By accessing or using our Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

1. IMPORTANT DISCLAIMERS: The Service is Not Investment Advice
This is the most important section of these Terms. Please read it carefully.
1.1. No Fiduciary Relationship
OptionsAware is a financial data and software tool. We are not a registered investment advisor, broker-dealer, or financial planner. Your use of the Service does not create a fiduciary, advisory, or any other type of professional financial relationship between you and Scathefire Media Inc.
1.2. For Educational and Informational Purposes Only
The Service, including all data, analysis, scoring (such as the RAE algorithm), and information, is provided for educational and informational purposes only. It is designed to help you analyze and monitor market data based on your own user-defined criteria.
1.3. You Are Solely Responsible for Your Decisions
You, and you alone, are solely responsible for evaluating the merits and risks associated with the use of any information or content provided through the Service before making any investment decisions. You are responsible for all trades you place and any and all consequences of your actions in the market.
1.4. No Guarantees of Performance
We make no guarantees as to the accuracy, completeness, timeliness, or reliability of any data or information provided through the Service. Past performance of any security, strategy, or algorithm is not indicative of future results. All investments involve risk, and you may lose some or all of your capital.
1.5. No Endorsements
The Service does not constitute an offer to sell, a solicitation of an offer to buy, or a recommendation for any security, nor does it constitute an offer to provide investment advisory or other services by us.
2. Description of Service
OptionsAware provides users with a set of software tools to access and analyze options market data. The Service allows users to:
- Access real-time and historical market data for stocks and options.
- Use impersonal, objective algorithms (like the RAE algorithm) to score and analyze opportunities.
- Set up and configure their own trading parameters, filters, and rules.
- Connect to their own brokerage accounts (e.g., Charles Schwab) via API to view data and, if they choose, to execute trades based on their own decisions.
- Monitor their own positions and performance.
You direct the Service's functions through your explicit inputs and settings.
The Service may include automated features such as trade monitoring and order execution. These features operate solely based on your explicit configurations and inputs. We do not guarantee their performance, and you remain solely responsible for all outcomes.
Website Accounts and Linking
- Website accounts use email + password as the primary identity.
- Telegram linking is optional and cannot create website accounts; it enables chat features and secondary sign-in only.
3. User Accounts and Responsibilities
3.1. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.
3.2. Account Security
You are responsible for maintaining the security of your website account (email + password), your Telegram account (if linked), and any connected brokerage accounts. Do not share credentials. You must immediately notify us of any unauthorized use of your account.
3.3. Accurate Information
You agree to provide accurate, current, and complete information when setting up and using your account.
3.4. Your Conduct
You are responsible for all activities that occur under your account.
3.5. Telegram Linking (Optional)
Linking requires an active website session. Only one Telegram account may be linked per user. If a Telegram account is already linked to a different user, you must unlink it from that account before linking. We may block or revoke links that violate these Terms or our policies.
4. Subscription and Fees
Certain features of the Service may require a subscription or payment. All fees are non-refundable except as required by law. We reserve the right to change our subscription fees upon reasonable notice.
4.1. Payment Terms
If you subscribe to paid features, you authorize us to charge your payment method for all applicable fees. Subscriptions may auto-renew unless canceled at least 24 hours before the renewal date. All payments are non-refundable except where required by law or in cases of our material breach.
5. License to Use the Service
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your own personal, non-commercial use, subject to these Terms.
6. Intellectual Property Rights
The Service and its original content, features, functionality, and algorithms (including but not limited to the RAE algorithm) are and will remain the exclusive property of Scathefire Media Inc and its licensors. You may not copy, modify, distribute, sell, or lease any part of our Service or included software.
7. Third-Party Services and Links
The Service integrates with third-party services, such as Charles Schwab and Telegram. Your use of these third-party services is governed by their respective terms and privacy policies. We are not responsible or liable for the content, products, or services of such third parties.
Market data provided through the Service is obtained from third-party sources and is provided "as-is." We make no warranties regarding its accuracy, completeness, or timeliness, and we are not liable for any errors, omissions, or delays.
8. Prohibited Activities
You agree not to use the Service to:
- Violate any applicable laws or regulations.
- Engage in any fraudulent, deceptive, or malicious activity.
- Reverse-engineer, decompile, or otherwise attempt to discover the source code of the Service.
- Resell, rent, or sublicense the Service or any data obtained from it.
- Use any automated system (bots, spiders, etc.) to access the Service in a way that sends more request messages to our servers than a human can reasonably produce in the same period.
9. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
You may terminate your use of the Service at any time by discontinuing use and requesting the deletion of your account.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCATHEFIRE MEDIA INC, ITS AFFILIATES, AGENTS, DIRECTORS, OR EMPLOYEES, BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS SERVICE.
UNDER NO CIRCUMSTANCES WILL WE BE RESPONSIBLE FOR ANY DAMAGE, LOSS, OR INJURY RESULTING FROM HACKING, TAMPERING, OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE (WHETHER IN CONTRACT, TORT, OR OTHERWISE) IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
11. Indemnification
You agree to defend, indemnify, and hold harmless Scathefire Media Inc and its employees, directors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service or a breach of these Terms.
12. Governing Law and Dispute Resolution
12.1. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
12.2. Binding Arbitration
You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the Service (collectively, "Disputes") will be settled by binding arbitration, except that each party retains the right to bring an individual action in small claims court and the right to seek injunctive or other equitable relief in a court of competent jurisdiction.
12.3. Waiver of Jury Trial and Class Action
YOU AND Scathefire Media Inc AGREE TO WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. YOU FURTHER AGREE THAT ANY ARBITRATION SHALL BE CONDUCTED IN YOUR INDIVIDUAL CAPACITY ONLY AND NOT AS A CLASS ACTION OR OTHER REPRESENTATIVE ACTION.
13. General Provisions
13.1. Entire Agreement
These Terms constitute the entire agreement between you and Scathefire Media Inc regarding our Service and supersede and replace any prior agreements we might have had between us.
13.2. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
13.3. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
13.4. Force Majeure
We shall not be liable for any failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or failures of third-party services (e.g., brokerage APIs or market data providers).
13.5. Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger or acquisition.
14. Beta Waitlist & Closed Beta
The OptionsAware beta is invite-only. Submitting your email adds you to a waitlist; access is granted at our sole discretion and capacity.
- Invites are single‑use, time‑limited, non‑transferable, and bound to the invited email.
- We may approve, decline, revoke, or reissue invites at any time.
- You consent to receive transactional emails for verification and invite delivery related to the waitlist.
- Prohibited: automated submissions, CAPTCHA bypass, token sharing, or attempts to enumerate registered emails.
- No compensation is provided for participation; you grant us a royalty‑free license to use beta feedback to improve the Service.
